What To Do when a Planning Application is Refused
If the authority refuses to give permission or apply specific conditions, they have to give a reason in writing. If you do not understand or are unclear about their reasoning, you should speak to a member of the staff at the local authority planning department. If the application has been refused, you can submit another application with the changes that have been made within 12 months of the first application. The changes should be discussed with the local authorities.
If you feel that the decision has been made in an unreasonable manner, you can appeal it with your local planning authority if you do not get a reason for the rejection in writing within eight weeks. Appeals are considered to be the last resort, as the decision can take up to several months. It is often faster to work out a decision with the local authority and make changes to the plan.
Reasons Why Planning Permission is Refused
Planning permission can be reused for several reasons, including but not limited to:
- Your new structure may overshadow your neighbour's home leading to a loss of light
- Your building will cause a loss of privacy for your neighbours
- Your structure does not fit in with existing properties
- There is overdevelopment in the area
- It may have an impact on highway safety
- Hazardous material is going to be used
- It will have a negative impact on the trees in the local area
- There will be less access to roads
- There will be a negative impact on local nature and wildlife
- Your property may be a listed building


There are some parts of the planning process that you cannot be rejected for. They include:
- The amount of time the job will take to complete
- Your planning history- if you had a previous plan rejected, this will not have an impact on your current plan
- Neighbour concerns that are not part of the policy such as the noise level of the job
- If the project will decrease the value of your property
- Private agreements
- Your personal information such as age, health, background, and your status
These are some common reasons why the application may have been rejected. Now that you have seen some common reasons for rejecting it, the process may be even more stressful, however, planning is not as scary as you think.
